New Policies for Implementation

BOARD RESOLUTION No. 20-S-2016 | ONE VEHICLE IN FRONT OF UNIT
A Unit owner or tenant may only park one (1) vehicle on a street in front of his unit depending on the One Side Parking Scheme of the month (Clarification of OSP Policy). Thus, if a member has more than one car, he has to park one inside his garage and the others at the vacant parking lanes in the village which is also depending on the OSP of the month.
EFFECTIVITY: Sept. 24, 2016


BOARD RESOLUTION No. 21-S-2016 | KARAOKE/VIDEOKE POLICY

1. No Videoke/Karaoke during weekdays
2. Saturday and Sunday may be allowed with permit, from 2pm to 10pm only. Beyond 10pm, penalty of 1000 per hour will be charged.
3. Videoke/Karaoke singing without permit shall be charged 3000 pesos per hour.
EFFECTIVITY: Jan. 1, 2017

BOARD RESOLUTION No. 23-S-2016 | ADDITIONAL REQUIREMENTS FOR TENANTS

1. All tenant shall be subject to the approval of the Board of Directors before move-in.
2. Personal appearance and orientation with the Village Manager before move-in.

Tricycle Drivers in Uniform

Dear Members,

Tricycle drivers who are in uniform are most likely legitimate members of a Tricycle Association and have the driver's license to take in passengers. In  your next tricycle ride to the village, make sure you and your household members ONLY RIDE with drivers in uniform for your protection.

Effective 22 September, our village will only allow entry of tricycle drivers who are in uniform or vest inside the villag.

Also on this date,  we shall implement a stricter entry rule to all tricycle units based on our recent Board Resolution (08-S-2014).  This resolution require tricycle drivers to turnover their IDs and licenses upon entry at the gate, keep 20 kph speed inside the village and reduce noise from their vehicles.

SJV3 Circular May 20

Fellow Homeowners,

Your Board would like to respond to the following issues that were raised during the General Membership Meeting last April 17, 2010, viz.

1. The engagement of Jones Lang LaSalle Leechui as village property manager;

2. Perceived high cost of security services being rendered by King Henry Security Agency

3. Resultant deficit due to increase of costs of two (2) services above-mentioned and

4. Results of the recently conducted election of the Village Board of Directors



On the engagement of Jones Lang LaSalle Leechui to take charge of the village management, let it be stated that the previous Board f Directors has conceived, from the beginning of its term in 2008, to explore the possibility to replace the previous village manager under Ms. Sanchez' Building Management and General Services Group (BMGSI). The move was made and was put into confidential discussion on the premise of the various concerns, feedbacks and silent moves and clamor to have a new village management and considering further that BMGSI has been with our village for more or less six (6) years. C.B. Richard Ellis Philippines, Inc. (CBRE), Global Land Property Management Inc. and FCP Group Philippines, were among the outfit the said previous Board considered and had some initial discussions. While admittedly, BMGSI has a very low management fee, the your previous Board was prompted by incessant complaints directed against the Village Manager herself as well as complaints from staff of BMGSI. This is precisely the reason why the previous Board had never renewed an annual agreement with BMGSI but instead put their engagement on a month-to-month basis. These issues prompted the then Board of Directors to pursue such replacement.

The current Board has put the Management Contract with Jones Lang under close review and scrutiny. Your five (5) member Board i.e. Directors Romero, Rodriguez, Samson, Madarang and Martinez, sans the two (2) members namely Director Madarang and Martinez who were part of the previous Board, will not participate in the evaluation on whether the engagement of the new Village Management is one which is advantageous to the Association and its appointment a sound exercise of discretion and judgment.

The engagement of King Henry Security Agency was prompted by persistent complaints of the previous security provider, ACT Security Agency. Acts of negligence, sleeping on duty, lack of respect, and even theft has prompted its replacement. Be reminded also that the various complaints also triggered the irregular and continuous replacement of ACT's Officer-in-Charge as well as the security guard on detail to the village. Our previous Board, in the exercise of its prerogative, has initially put a working budget cap as a way to have flexibility in determining the reasonable cost vis-a-vis the PADPAO rate. Four (4) agencies participated in the bidding including the ACT Security. Presentations were made during the monthly Board meeting last February 2009 and after deliberation, it was awarded to King Henry as recommended by Ms. Sanchez, the then Village Manager.

While both the engagement of jones Lang as the new Village Management as well as the improvement in the cost of the security services entails additional cost, a benchmark evaluation of similar services being rendered to other villages within the Sta. Rosa-Biñan area, whether the same were developed by Avida (formerly LPHI) and/or other developers, the cost of which versus our village management fee are competitive and thus reasonable. The establishment of such gauge to determine reasonableness also provide our Association such protection in case of suits that may result due to labor and employment concerns that may arise being secondary employers and may be liable for unclaimed wages and benefits of village management staff. Finally, it must also be emphasized that our present rate of assessment dues was computed and established way back in 2004 and while the previous Board of Directors ably managed to cushion the effects of guaranteed increases in maintaining the village, it will certainly reach to a point that our collection, both actual and projected, will inevitably not enough to sustain such village maintenance costs.

As regards to the just concluded village election, while everyone recognizes the independence in the creation, appointment, process and the decisions rendered by the Election Committee (EleCom) during the entire exercise, let it be settled that your new Board fully support all the actions, prerogatives, judgment as well as the submitted recommendations of the EleCom. While we understand that there were some contentious issues raised during the election day itself, suffice it to state that we commend the EleCom in the way they were able settle the same, guided by the existing rules set, as well as the By-Laws of the Association.

In closing, your new Board will discuss above matter at length in a General Membership meeting we will be setting in the near future.

EXCERPT FROM THE MINUTES OF THE MEETING OF THE BOARD OF
DIRECTORS OF THE SJV III HOMEOWNERS ASSOCIATION HELD ON
FEBRUARY 8, 2009 AT THE ADMINISTRATION OFFICE.

BOARD RESOLUTION 001-05

WHEREAS, the SJV Ill Homeowners Association has continue to bill all its members of their association dues to be able to build up funds for the Association and sustain the
payment of administrative services; security services; costs of street lights, water, maintenance of the clubhouse, park, playground, and sports facilities, garbage collection fees, taxes, and many other administrative and maintenance services for the benefit of the entire SJV Ill community;

WHEREAS, while many homeowners and residents have paid their dues religiously, other homeowners have unpaid dues in spite of their continued enjoyment of services and benefits which is unfair to the homeowners and residents who pay their dues on time;

WHEREAS, statements and bill reminders were sent, collection visit were undertaken to keep them always reminded of their financial obligations to the Association, but such accounts remain unpaid;

NOW THEREFORE, RESOLVED AS IT IS HEREBY RESOLVED, the Board approved that the following sanctions as embodied to the Village Rules and Regulations be implemented effective March 7, 2009 to all homeowners and residents whose association dues remain unpaid as of December, 2008;

1. The Administration Office will not give entry and exit permits to their tenants, their furniture and belongings;
2. No requests for the construction permit or any other services from the Administration Personnel will be attended and approved;
3. Outside mails and correspondence of the delinquent homeowners and residents will not be delivered by our security guards. Concerned residents will have to get their mails from the gate guards;
4. The guests of delinquent homeowners and residents who are not notified in advance to the gate guard will be required to leave their ID’s at the gate and will not be assisted by the guards.
5. Delinquent homeowners and residents will be required by the Gate guard to leave any valid government-issued ID with picture (SSS, GSlS, Passport, PRC or Drivers License) before allowing entry to the village. Upon further advice from the Board, the Gate guard may have the option not to lift the boom for them.
6. Their garbage will not be collected by Dynahaul.
7. They cannot participate in any meetings called for by the Board of Directors and vote during elections.

RESOLVED FURTHER that the names of the homeowners and residents with overdue accounts as of December, 2008 shall be posted in conspicuous areas within the village specifically at the Gate and at the Clubhouse by March 7, 2009;

RESOLVED FINALLY that the copies of this resolution be circulated to everybody and above sanctions be implemented against those homeowners and residents with overdue accounts as of December, 2008 and remain unpaid until March 7, 2009.

DIRECTORS'  CERTIFICATE


WE, the members of the board of directors of SAN JOSE VILLAGE III HOMEOWNERS' ASSOCIATION, in the meeting of the Board of Directors held on August 19, 2008 at the Clubhouse, during which a quorom was present and acting throughout, the following measure was adopted by the unanimous vote of the members of the Board so as to make the Village road safe to homeowners and tenants alike:


BOARD RESOLUTION 07-S-2008 20KPH FULL COMPLIANCE
   "WHEREAS, the Board has passed a resulotion 03-s-2007 on November 17, 2007, encouraging all homeowners to observe full compliance to the 20-kph rule and posted 20-kph signage in strategic locations within the Village;


   "WHEREAS, the 20-kph signage were relocated in the middle of the road in December, 2007 because of the continued non-observance of the 20-kph rule by a significant number of motorists inside the village;


   "WHEREAS, observation were made that while most of the homeowners complied with the 20-kph rule as mandated in the signage in the middle of the road, there are still a few homeowners/motorist who to continue to ignore the 20-kph whiel driving inside the village,


   "NOW THEREFORE, RESOLVED AS IT IS HEREBY RESOLVED, that effective immediately, the following rule shall be enforced by the Seciruty and Administration office against homeowners and/or motorist who will not comply with the 20-kph and are over-speeding while driving inside the village:


      1. FIRST OFFENSE       Verbal reminder and issuance of the Reminder  on the Village Rules (RVR) to be issued by the Security Guard;


      2. SECOND OFFENSE   Village Reminder to be issued by the Village Manager with BAN WARNING


      3. THIRD OFFENSE    BAN OF THE VEHICLE FROM ENTRY INSIDE THE VILLAGE to be issued by the Board of Directors.


"RESOLVE FINALLY, that copy of this resolution be circulated to all homeowners for their information and guidance."
